Tom From: Paul Schlie [] Sent: Thursday, December 03, 2015 5:57 AM To: Tom Johnson Cc: Karen Edwards; Michael Behrendt Subject: Re: Upcoming 15 Foss Farm Rd ZBA Request (final corrected version/2) Tom, Per our brief discussion, for the board: With respect to the proposed development of the property shown in Map 6 as Lot 1-11, located at 15 Foss Farm Road; I respectfully ask it be first determined if it’s a valid pre-exiting non- conforming (undersized) lot, as Article IX 175-29.A-C would seem to require that upon the establishment of pertinent zoning restrictions, all lots then deemed non-conforming adjacent to a co-owned lot within the same zoning district not approved and duly recorded within the same sub-division, are required to be adjoined to effectively remove the non-previouly approved zoning non-confomity. However, as my intent is not to prohibit the undersized lot’s use if determined to be a valid non- conforming lot, but merely to restrict its use to be more consistent to the lower density intent of a Residential-B zoned district, I merely ask that the lot's use be formally agreed to be restricted by covenant to exclusively hosting a single family residence (as stipulated per by Article IX 175- 29.A), and thereby formally prohibited from any other use without a variance, inclusive of hosting an accessory apartment, etc. identified as separate uses per Article XII 175-53/54 (tables); and ideally further restricted to housing no more than two unrelated occupants, in an effort to discourage its use as yet more student housing, being often to the predominant benefit of the owner at the expense of the neighborhood, especially in zoning districts intended to maintain lower density, presuming the other variances asked are acceptable to the board; otherwise I would ask that no variance be granted.
